BREAKING: RELEASE OF February 11 hud memo erasing women
The details are below. The gist is this: UNLESS I AM READING THIS WRONG, THE BIDEN ADMINISTRATION HAS, AS OF FEBRUARY, DIRECTED THAT MEN BE HOUSED IN FEMALE-ONLY HOUSING FACILITIES ALL ACROSS THE COUNTRY. IT HAS DONE SO WITH NO NOTICE OR PUBLIC COMMENT.
THIS IS NOT A DRILL.
Introduction
On February 11, 2021, the Department of Housing and Urban Development (HUD) issued this memo to three entities within the Department:
The Office of Fair Housing & Equal Opportunity (FHEO);
Fair Housing Assistance Program Agencies (FHAP); and
Fair Housing Initiatives Program Grantees (FHIP).
The Department issued this memo with no notice and/or comment and, as far as I am able to discern, no compliance with any federal rule-making procedures.
The Heart of the Memo
The new policy directive at the heart of the memo is that the Fair Housing Act, which prohibits discrimination in housing, must now be interpreted such that “sex discrimination” includes discrimination on the basis of “gender identity” in housing facilities across the country.
All of this is grounded in the Supreme Court’s 2020 decision in Bostock, which held that “sex discrimination” includes discrimination on the basis of “transgender status” (without defining “transgender status”) in employment, which the Biden administration has (possibly unlawfully) expanded to include all federal administrative laws and policies and, now, the Fair Housing Act.
What the Memo Does
The memo does three things, retroactively to January 20, the day that President Biden signed Executive Order 13988 on Preventing and Combating Discrimination on the Basis of Gender Identity or Sexual Orientation.
Directs the FHEO to immediately begin accepting complaints alleging sex discrimination on the basis of “gender identity” in housing, against any entity that is governed by the Fair Housing Act (which includes “nearly all housing, including private housing, public housing, and housing that receives federal funding, in HUD’s own words”).
Orders all FHAP agencies to “explicitly prohibit discrimination because of gender identity and sexual orientation or … include prohibitions on sex discrimination that are interpreted and applied to include discrimination because of gender identity and sexual orientation.” FHAP agencies are state and local agencies that administer fair housing laws that provide rights and remedies that are substantially equivalent to those provided by the Fair Housing Act and that receive federal funding.
Requires all FHIP organizations to “interpret sex discrimination under the Fair Housing Act to include discrimination because of sexual orientation and gender identity.” FHIP organizations are fair housing organizations and other non-profits that receive HUD funding to assist people who believe they have been victims of housing discrimination.
The only reason that I even know about the February 11 HUD memo is that ADF recently filed this lawsuit alleging that because of the memo, colleges are now required to house male students in women’s dormitories, if they claim to have a female “gender identity.”
Questions that Remain:
I have a lot of questions, but for now, I will just ask the following questions of President Biden and Vice President Harris -
How many college women have to be raped in women’s dormitories at the altar of “gender identity?”
How many domestic abuse victims have to be assaulted in rape shelters at the altar of “gender identity?”
How many homeless women and children have to be abused in homeless shelters at the alter of “gender identity?”
